Terms & Conditions

Terms & Conditions

Effective date: April 11, 2026

These Terms & Conditions (“Terms”) govern your access to and use of the MyHealthCloud mobile application, websites, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1) Plain-language summary (non-binding)

  • You own the content you upload; you give us permission to process it to provide the Service.
  • AI insights are informational only and are not medical advice.
  • Subscriptions renew unless canceled through your Apple App Store / Google Play settings.
  • We limit certain types of liability in a consumer-friendly way while protecting the business.

This summary is for convenience only. If there is a conflict between this summary and the Terms, the Terms control.

2) Definitions

  • “Company,” “we,” “us,” “our”: Myhealthcloud
  • “Service”: the MyHealthCloud app, websites, and related services.
  • “Content”: anything you upload, submit, store, or create in the Service, including health-related information and documents.
  • “Health Data”: Content that relates to your health, such as lab reports, results, notes, and related metadata.
  • “AI Outputs”: extracted data, summaries, classifications, trend warnings, or insights produced by automated processing.

3) Eligibility

You must be legally capable of entering into these Terms and meet any minimum age requirement described in our Privacy Policy.

If you use the Service on behalf of someone else (for example, adding or managing family profiles), you represent that you have the authority and required consent to do so.

4) Account registration & security

  • You must provide accurate and current information when creating and maintaining your account.
  • You are responsible for keeping your login credentials secure and confidential.
  • You are responsible for all activity that occurs under your account.
  • We may suspend or restrict access to protect you, other users, or the Service (for example, if we suspect unauthorized access, fraud, or abuse).

5) The Service (what we provide)

MyHealthCloud helps you store, organize, and understand health records and related information you provide. Certain features may use automated systems (including AI) to extract and present information in structured formats, such as lab report extractions and trend summaries.

We may update, modify, add, or remove features over time. We do not guarantee that any particular feature will always be available.

6) Important health / AI disclaimers

6.1 NO MEDICAL ADVICE (CRITICAL DISCLAIMER)

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. THE SERVICE AND ANY AI OUTPUTS (INCLUDING AI-GENERATED ANALYSES, LAB REPORT EXTRACTIONS, AND TREND WARNINGS) ARE FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROFESSIONAL WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ OR SEEN IN THE SERVICE.

6.2 No emergency use

Do not use MyHealthCloud for emergency situations. If you suspect an emergency, contact your local emergency number or seek immediate medical assistance.

6.3 AI limitations and verification

AI systems can make mistakes. AI Outputs may be incorrect, incomplete, or outdated, and may misread values (including numbers) from your documents.

You are responsible for verifying accuracy against your original documents and professional guidance before relying on any AI Outputs.

7) Your content & permissions (license)

7.1 Ownership

You retain ownership of your Content. We do not claim ownership of your health records or other Content.

7.2 License to operate the Service

To operate the Service, you grant the Company a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your Content solely to:

  • provide and operate the Service you request;
  • maintain, secure, and improve the Service;
  • comply with law and enforce these Terms.

This license ends when your Content is deleted from the Service, except to the extent we must retain certain information for legal, security, or operational purposes (as described in our Privacy Policy).

7.3 Your responsibilities for Content

You agree that you will not upload or submit Content that:

  • you do not have the right or permission to use (including someone else’s records without appropriate authority/consent);
  • violates applicable law or infringes privacy rights;
  • contains malware, harmful code, or attempts to disrupt the Service.

8) Acceptable use

You agree not to:

  • misuse the Service (including hacking, scraping, interfering with operations, introducing malware, or attempting unauthorized access);
  • use the Service in ways that violate law or regulations;
  • attempt to reverse engineer or circumvent protections of the Service, except where permitted by law;
  • use the Service to provide regulated medical services unless you are authorized and compliant with applicable requirements.

We may remove Content or suspend/terminate accounts for violations.

9) Subscriptions, billing, and renewals

9.1 Subscription management

Subscriptions are handled through the Apple App Store and/or Google Play Store and can be managed in your store account settings. We may use third-party services (for example, RevenueCat) to manage subscription entitlements within the Service.

9.2 Renewals and cancellations

  • Subscriptions typically auto-renew unless canceled before the renewal date in your App Store / Google Play subscription settings.
  • Refunds are governed by Apple/Google policies, unless required otherwise by applicable local law.

9.3 Price changes

If subscription pricing changes, we will provide notice where required, and platform rules will apply.

10) Third-party services

The Service may rely on third-party providers, for example for authentication, hosting, analytics, AI processing, or subscription management. Your use of those third-party services may also be subject to their own terms and policies. Details about what personal data and health data we collect, how we use it, and which service providers process it on our behalf are described in our Privacy Policy.

We are not responsible for third-party services outside our control.

11) Beta features

Some features may be labeled beta, preview, or experimental. Beta features may be unstable, change without notice, or be discontinued. You use beta features at your discretion and acknowledge that they may not work as intended.

12) Intellectual property

The Service, including software, designs, trademarks, logos, and documentation, is owned by the Company or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as allowed by law and these Terms.

13) Termination

13.1 By you

You can stop using the Service at any time. You may request account deletion in accordance with our Privacy Policy.

13.2 By us

We may suspend or terminate your access if:

  • you materially breach these Terms;
  • we must do so to comply with law or protect security;
  • your use creates risk or harm to the Service, the Company, or others.

Where reasonable, we will provide notice and an opportunity to remedy.

14) Disclaimer of warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted operation, error-free performance, or that AI Outputs will be accurate, complete, or suitable for your purposes.

Some jurisdictions do not allow certain warranty disclaimers. In those cases, this section applies to the maximum extent permitted by law.

15) Limitation of liability

To the maximum extent permitted by law: We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data, arising from or related to your use of (or inability to use) the Service or any AI Outputs.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud, willful misconduct, or certain statutory consumer rights).

16) Indemnification (narrow, reasonable)

You agree to indemnify and hold the Company harmless from third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • your unlawful use of the Service;
  • your Content (including lack of rights/consent to upload it);
  • your violation of these Terms.

We will promptly notify you of any such claim and cooperate as required.

17) Governing law & dispute resolution

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. You and the Company agree that the courts located in Hong Kong will have jurisdiction over disputes arising out of or relating to these Terms or the Service.

Nothing in these Terms limits any consumer rights that cannot be excluded or limited under applicable law.

18) App Store / Google Play compliance

If you downloaded the app from Apple or Google:

  • These Terms are between you and the Company, not Apple/Google.
  • Apple/Google have no obligation to provide support for the Service.
  • You must comply with applicable App Store / Google Play terms and policies.

19) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (for example, outages, natural disasters, war, terrorism, labor disputes, or internet/service provider failures).

20) Entire agreement & severability

These Terms and the Privacy Policy form the entire agreement between you and the Company regarding the Service and supersede any prior agreements on the subject.

If any provision is held unenforceable, the remaining provisions remain in effect.
